Reintroduction of tolerances for exceeding the maximum permitted weights and/or dimensions of motor vehicles
In the Official Gazette number 51 of 19.01.2024 was published ORDINANCE no. 4 of January 18, 2024 for the amendment and completion of Government Ordinance no. 43/1997 regarding the road regime. The Ordinance reintroduces the tolerances for exceeding the maximum permitted weights and/or dimensions of motor vehicles.
Thus, a Special Transport Authorisation (AST) is NOT issued and contraventional sanctions are NOT applied if:
- by weighing the vehicle, the maximum permitted total weight is exceeded by no more than 5% inclusive
- by weighing the vehicle, the maximum permitted weight on the axles is exceeded by no more than 4% inclusive
- by measuring the length of the vehicle, the maximum permitted length is exceeded by no more than 1% inclusive
- by measuring the width of the vehicle, the maximum permitted width is exceeded by no more than 2% inclusive
- by measuring the height of the vehicle, the maximum permitted height is exceeded by no more than 1% inclusive.
The provisions mentioned above enter into force 30 days after publication in the Official Gazette, respectively on February 17, 2024.
It should be noted that UNTRR reported to the authorities inconsistencies in the weighing/measuring of vehicles at the border crossing points, after the entry into force of the law which eliminated the tolerances for exceeding the maximum permitted weights and dimensions, and the Romanian Bureau of Legal Metrology found errors of measurement at a series of scales following UNTRR interventions.
